San Francisco Police Arrest Homicide Suspect 21-138
On Sunday, July 18, 2021, at approximately 6:20 p.m., San Francisco Police officers from Tenderloin and Southern Stations responded to the area of 7th and Mission Streets for a report of a shooting. Officers arrived on scene and located a 15-year-old male suffering from apparent gunshot wounds. Officers rendered aid to the victim and summoned medics to the scene. The victim was transported to a local hospital where he succumbed to his injuries.
Tenderloin officers were in the area of 7th and Market Street when they heard the sound of gunshots. Officers observed a white sedan fleeing northbound 7th Street at a high rate of speed. Believing the vehicle may have been involved in the incident, the officers activated the lights and sirens on their patrol vehicle and attempted to affect a traffic stop on the suspect vehicle. The suspect failed to yield and continued to flee to westbound McAllister at a high rate of speed. Officers observed the vehicle drive through a red light at the intersection of McAllister and Hyde Streets. The vehicle collided with a pedestrian who was in the crosswalk. The officers terminated the pursuit, broadcasted the vehicle description over their department radios, and stopped to render aid to the pedestrian. The pedestrian, a 40-year-old male, was transported to a local hospital with non-life-threatening injuries.
While on the scene of the shooting incident, investigators were advised that the suspect vehicle was involved in vehicle collisions at 10th and Mission Streets and 10th and Harrison Streets. In each incident, the suspect collided with one vehicle. The involved victim driver at 10th and Harrison Streets was treated for non-life-threatening injuries. The occupants of the victim vehicle at 10th and Mission Streets were uninjured. The suspect vehicle was last observed driving towards US Highway 101 southbound.
At approximately 6:45 p.m., SFPD officers from Bayview Station responded to the area of 20th and Vermont Streets for a report of a vehicle collision. Witnesses reported a white sedan crashing in the area and the driver exit the vehicle and flee on foot. The description of the vehicle and the suspect matched that of the vehicle and suspect involved in the shooting on 7th Street.
Officers canvassed the area for the suspect and located him in the foliage on the embankment of Highway 101. The suspect ran northbound on the side of the freeway before running into traffic and crossing to the center median. Officers pursued the suspect on foot until the suspect surrendered and was taken into custody without further incident.
The suspect was identified as 41-year-old Bernard Hayes of San Francisco.
Officers retraced the flight path of Hayes and located a firearm that appeared to have been recently discarded. Officers also located suspected cocaine base on Hayes’ person.
Hayes was transported to a local hospital where he was treated for non-life-threatening injuries. Hayes was later booked at San Francisco County Jail on the following charges; murder (187 PC), robbery (211 PC), carrying a loaded firearm (25850(a) PC), reckless evading of a police officer (2800.2 CVC), felony hit and run (20001 CVC), misdemeanor hit and run (20002 CVC), resisting arrest (148(a)(1) PC), failure to yield to a pedestrian (21950(a) CVC), driving on a suspended license (14601.1(a) CVC), and possession of a controlled substance (11350(a) H&S).
This incident is being investigated by the SFPD Homicide Detail and Traffic Collision Investigation Unit.
